This English text is provided for convenience. The Korean version prevails in case of any inconsistency (Article 15).
Article 1 (Purpose)
These Terms govern the rights, obligations and responsibilities between VoyagerX, Inc. (the "Company") and users in connection with the Cubio service (the "Service").
Article 2 (Definitions)
- "Service" means the web service operated by the Company through which users generate elements such as figures and backdrops by entering prompts (text) or photos into generative AI, compose them into 3D cube-shaped dioramas ("Cubes"), publish and share them, and interact with other users.
- "User" means any person using the Service under these Terms.
- "Generated Content" means figures, backdrops, 3D meshes and Cubes composed from them that generative AI produces based on a User's prompt or provided photo.
- "Post" means a Cube a User has published (made public) within the Service.
- "Comment" means opinions or other content a User writes on a Post.
- "User Content" means all content a User inputs, generates or posts through the Service, including prompts, provided photos, Generated Content, Posts, Comments and profile information.
- "Credits" means the in-service usage units the Company grants to Users free of charge to manage generative-AI usage. Credits have no monetary value and cannot be refunded, transferred or redeemed for cash.
Article 3 (Posting and Amendment of Terms)
- The Company posts these Terms within the Service so Users can easily find them.
- The Company may amend these Terms within the bounds of applicable law. Amendments, together with the effective date and reasons, are announced within the Service at least 7 days before the effective date, or at least 30 days before if the amendment is unfavorable to Users.
- Continued use of the Service after the effective date constitutes acceptance of the amended Terms. Where necessary, the Company may ask Users to expressly re-accept the amended Terms and the Content Policy before using content-creation or posting features.
Article 4 (Formation of the Agreement; Minimum Age)
- The agreement is formed when a User agrees to these Terms and the Privacy Policy, confirms (by checkbox) that they are aged 14 or older, and then creates an account or uses the Service.
- The Service is available only to persons aged 14 or older. Persons under 14 must not use the Service. The Company may, without prior notice, restrict or delete the account of any User confirmed or reasonably suspected to be under 14 and promptly destroy the related personal information.
- Users must provide accurate information when signing up and bear any disadvantage arising from false information. The Company is not responsible for consequences arising from a User's provision of false information.
- Users choose a username for use within the Service and must not impersonate another person or trademark or use an inappropriate username. The Company may require a change to, or directly change, such usernames.
Article 5 (Contents of the Service)
- The Company provides:
- Creation and editing of Generated Content (figures, backdrops, Cubes) from prompt or photo input
- Publishing and sharing of Cubes with other Users (including link sharing and image/video export)
- Interaction features such as comments and likes on Posts and following other Users
- Other ancillary services determined by the Company
- User Content such as published Cubes and the prompts used to generate them, Comments and usernames may be disclosed and shared with other Users, and published Cubes can be viewed via link by anyone, including people who are not signed in. By publishing content, Users are deemed to consent to such disclosure. Unpublished Cubes (works in progress) and original photos provided by Users are not disclosed to other Users.
- The Service is operated on the basis of generative AI, and Generated Content is produced by generative AI.
- To manage generative-AI usage, the Company may set daily Credit limits per User and for the Service as a whole; when a limit is reached, generation features are temporarily restricted. The Company determines Credit grants, deduction criteria and limits, which may change without prior notice.
Article 6 (Provision, Change and Suspension of the Service)
- The Service is at a proof-of-concept (PoC) stage and is provided free of charge on an experimental basis.
- The Company may change, suspend or terminate all or part of the Service without prior notice and is not liable for any resulting damage to Users, except in cases of the Company's willful misconduct or gross negligence.
- The Company does not guarantee the storage, retention or availability of User data including Generated Content; data may be lost upon change, suspension or termination of the Service.
Article 7 (Company's Intellectual Property)
- Copyright and other intellectual property rights in all assets constituting the Service—platform, software, generation pipeline, prompt templates, designs, user interface, trademarks and logos (including the "Cubio" name and logo), text, databases, etc.—belong to the Company or their rightful owners.
- Users may use such assets only to the extent necessary to use the Service and may not reproduce, distribute, transmit, publish, create derivative works from, reverse-engineer or decompile them, or allow third parties to use them, without the Company's prior written consent.
Article 8 (Rights in User Content and Generated Content)
- Users retain their rights in the photos and prompts they provide. Users warrant that they hold the rights necessary to use the provided photos and prompts in the Service, including the consent of any other person appearing in a photo.
- The Company makes no warranty regarding the ownership or copyrightability of Generated Content. The legal status of generative-AI output may vary by jurisdiction and circumstance.
- The Company may store, reproduce, modify, display and transmit User Content to the extent necessary to provide, operate, improve, display and share the Service (including generating link-preview thumbnails).
- With respect to published Cubes only, Users grant the Company a non-exclusive, worldwide, royalty-free license to use, reproduce, display, distribute and create derivative works for the purpose of promoting and marketing the Service (the Company's website, social media, advertising materials, etc.), subject to the following limitations:
- Original photos provided by Users are not included.
- The Company will make reasonable efforts to credit the author's username when using the content.
- If a User deletes or unpublishes the Cube, the Company will cease new uses thereafter; materials already produced or placed are excepted.
- Unpublished Cubes and Comments are not included.
- Users may view, share and use other Users' Posts within the features the Service provides (e.g., link sharing, remixing under paragraph 6) but may not otherwise reproduce, distribute or commercially exploit them.
- The Company stores the prompts Users enter and the resulting Generated Content, and may, as a feature of the Service, display the prompts and Generated Content used in published Cubes to other Users or allow other Users to create their own Cubes based on them ("Remix"). By publishing a Cube, a User permits other Users to use its prompts and Generated Content for Remix within the Service. Original photos provided by Users and the prompts and Generated Content of unpublished Cubes are not subject to Remix. If a User deletes or unpublishes a Cube, new Remixes cease thereafter, but Cubes already created by other Users remain.
Article 9 (User Obligations and Prohibited Conduct)
Users must comply with applicable law, these Terms and the Content Policy and must not:
- Generate or post content that infringes others' copyright, trademark, likeness/publicity rights, personal information, reputation or other rights
- Provide photos of another real person without that person's consent, or use them to create Generated Content that identifies that person
- Generate or post illegal or harmful content, including sexual exploitation of children or minors, sexually explicit content, hate or discrimination, harassment, promotion of self-harm, gratuitous violence, or content that facilitates illegal acts
- Disparage, insult, defame, threaten or harass others, or repeatedly post spam, through Comments or otherwise
- Enter another person's personal or sensitive information (health, beliefs, political opinions, etc.) into prompts or photos, or include it in User Content, without that person's consent
- Interfere with normal operation of the Service, circumvent Credit limits, generation limits or filters, access the Service by automated means (bots, scripts), or abuse the system by creating multiple accounts
- Use the Service or Generated Content to deceive others or spread false information
- Otherwise violate applicable law or these Terms
If a User breaches these obligations, the Company may refuse to provide the Service to that User.
Article 10 (Content Management)
- Generation of certain prompts or photos may be refused under the safety policies of the generative-AI providers the Company uses, and the Company may additionally apply automated safety filters to AI inputs and outputs where necessary. Automated filters do not guarantee detection of all harmful content or accurate classification of all legitimate content.
- Users may report content or Users they believe violate Article 9 or the Content Policy through the contact channel (email) in Article 13, including the link to the Cube, Comment or profile concerned and the reason.
- The Company reviews reported content and, where it determines that User Content violates or is likely to violate Article 9 or the Content Policy, may without prior notice suspend, delete or restrict access to the content or restrict the account.
- The Company does not pre-screen all User Content. Viewing content generated or posted by other Users is at the User's own judgment and risk.
Article 11 (Disclaimer of Warranties; Limitation of Liability)
- The Service is provided "as is." The Company makes no express or implied warranty as to the accuracy, completeness, suitability, safety, non-infringement or fitness for a particular purpose of the Service or Generated Content.
- The Company is not responsible for User Content, prompts or photos that Users provide, generate or post; responsibility lies with the User who provided, generated or posted them.
- The Company is not liable for damage caused by events beyond its reasonable control, including force majeure, the User's own fault, or acts of third parties (generative-AI providers, cloud providers, etc.).
- Given that the Service is provided free of charge, the Company's liability is limited to the maximum extent permitted by applicable law, except for damage caused by the Company's willful misconduct or gross negligence.
Article 12 (Damages)
- A User who causes damage to the Company or a third party by breaching these Terms is liable for such damage.
- If a third party raises a claim or demands compensation from the Company due to a User's breach, the User shall indemnify and hold the Company harmless at the User's own cost and responsibility.
Article 13 (Inquiries and Objections)
- Users may use the email below for inquiries about the Service, bug reports, content reports, account-deletion requests, and objections to actions the Company takes under Article 9 or the Content Policy.
- Contact: privacy@voyagerx.com
- The Company responds within a reasonable period considering the order of receipt and nature of the matter, but does not guarantee a response to every inquiry.
- Content and materials submitted for inquiries are used only to handle the inquiry, verify errors and improve the Service, and are not posted or shared within the Service.
- Users must not abuse the contact channel (excessive provision of others' personal information, abusive language, repeated identical submissions, etc.); the Company may restrict receipt of inquiries in such cases.
Article 14 (Termination and Account Deletion)
- Users may request account deletion at any time via the contact channel in Article 13. After verifying that the requester is the account holder, the Company deletes the account and related data within a reasonable period. Deleted data cannot be recovered.
- The Company may terminate the agreement or delete an account without prior notice if a User violates these Terms.
Article 15 (Governing Law and Jurisdiction)
- These Terms and the Service are governed by the laws of the Republic of Korea, regardless of the User's country of residence.
- The Seoul Central District Court has jurisdiction as the court of first instance over disputes between the Company and Users arising in connection with the Service.
- These Terms are written in Korean, with an English translation provided for reference. In case of any inconsistency between the Korean text and a translation, the Korean text prevails.
Article 16 (Notice to Users Residing in the United States)
- The Service is operated from the Republic of Korea. Personal information of Users residing in the United States is transferred to and processed in the Republic of Korea and the countries specified in the Privacy Policy.
- The Company does not knowingly collect personal information from children under 13 (U.S. Children's Online Privacy Protection Act, COPPA). Under Article 4, the Service is available only to persons aged 14 or older; if the Company learns that information from a child under 13 has been collected, it deletes such information without delay.
- Because the Company's generative-AI providers and cloud providers are located in the United States, User Content may be processed within the United States. See the Privacy Policy for details.
Addendum
These Terms take effect on August 28, 2026.
